1. Acceptance of Terms
By accessing or using UnitedRaise ("the Platform"), operated by UnitedRaise LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organization (such as a school or sports league), you represent that you have authority to bind that organization to these terms.
2. Description of Service
UnitedRaise is an AI-powered fundraising platform designed for sports teams and youth organizations. The platform provides tools for creating campaigns, managing teams, generating fundraising content, and processing donations. UnitedRaise is a technology platform and payment facilitator, not a charity or nonprofit organization.
3. Accounts and Eligibility
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Team admins ("Coaches") are responsible for managing their team members and ensuring appropriate use of the platform. Team admins must be at least 18 years old. Student/member accounts may be created for minors under the supervision of a team admin.
4. Platform Fees
UnitedRaise charges a 10% platform fee on all donations received through the platform.
This fee covers payment processing, platform maintenance, AI content generation, and customer support. There are no upfront costs, monthly fees, or hidden charges. The platform fee is automatically deducted from donation proceeds before payout to your organization. For example, a $100 donation results in a $90 payout to your team.
5. Donations and Tax Status
Important: Donations made through UnitedRaise are generally NOT tax-deductible.
UnitedRaise facilitates donations to sports teams and youth organizations, which are typically not registered 501(c)(3) charitable organizations. Donors should not expect to claim donations as charitable contributions on their tax returns unless the receiving organization has provided written confirmation of their tax-exempt status. It is the donor's responsibility to consult with a tax professional regarding the deductibility of any contribution.
Donors acknowledge that their contributions are voluntary gifts to support the stated campaign purpose. Donations are made directly to the fundraising team, not to UnitedRaise.
6. Refund Policy
For Donors: Donation refunds may be requested within 30 days of the original transaction by contacting support@unitedraise.com. Refunds are processed at UnitedRaise's discretion and may be denied if funds have already been disbursed to the campaign organizer or if fraud is suspected. Payment processor fees may not be refundable.
For Campaign Organizers: If a refund is issued after funds have been disbursed, the refund amount plus any associated fees may be deducted from future payouts or recovered from the campaign organizer.
Chargebacks: In the event of a payment dispute or chargeback, UnitedRaise reserves the right to deduct the disputed amount plus any fees from pending or future payouts. Campaign organizers agree to cooperate with any dispute investigation.
7. Payouts
Campaign organizers must configure valid payout settings (bank account or mailing address for check) before creating campaigns. Payouts are processed after the campaign end date, typically within 3-5 business days. UnitedRaise reserves the right to delay payouts pending verification or fraud investigation. Minimum payout threshold is $10; amounts below this may be held until the threshold is met.
You are responsible for any taxes owed on funds received. UnitedRaise may issue tax documents (such as 1099 forms) as required by law for payouts exceeding IRS thresholds.
8. Campaign Requirements
Campaigns must have a clear, legitimate fundraising purpose. Campaign organizers agree to:
- Use funds for the stated campaign purpose
- Provide accurate descriptions of their team and fundraising goals
- Not misrepresent their organization, affiliation, or tax status
- Set realistic end dates for campaigns
- Respond to donor inquiries in a timely manner
Campaign Deletion: Campaigns that have received donations cannot be deleted. This ensures donation records are preserved for donor verification and tax compliance purposes. You may end a campaign at any time to stop accepting new donations.
9. Prohibited Activities
You agree not to use the platform for:
- Fraudulent fundraising or misrepresentation of campaign purpose
- Personal enrichment disguised as team fundraising
- Political campaigns, lobbying, or advocacy unrelated to youth sports
- Any illegal activity or purpose
- Harassment, spam, or unsolicited commercial communications
- Collecting donations for organizations you are not authorized to represent
- Money laundering or structuring transactions to avoid reporting requirements
10. Contact Information and Communications
You are responsible for obtaining appropriate consent before adding contact information to the platform for fundraising outreach. You must comply with applicable communication laws, including CAN-SPAM and TCPA regulations. You represent that you have a pre-existing relationship with contacts you add (family, friends, community members) and that they have a reasonable expectation of receiving communications about your team's fundraising.
11. AI-Generated Content
UnitedRaise uses artificial intelligence to generate campaign descriptions, messages, and other fundraising content. While we strive for quality, AI-generated content should be reviewed before use. You are responsible for the accuracy and appropriateness of the final content shared in your campaigns. UnitedRaise is not liable for any errors, inaccuracies, or unintended content in AI-generated materials.
12. Data Retention
Donation records are retained for a minimum of 7 years for tax compliance and financial reporting purposes. Account data is retained while your account is active. See our Privacy Policy for complete details on data handling.
13. Suspension and Termination
UnitedRaise reserves the right to suspend or terminate accounts, campaigns, or payouts at our discretion if we believe there has been a violation of these terms, fraudulent activity, or misuse of the platform. We will attempt to provide notice before taking action except in cases of fraud or legal requirement. Suspended campaigns may have payouts held pending investigation.
You may terminate your account at any time through your account settings. Termination does not affect any pending refund claims by donors or our right to recover amounts owed.
14. Limitation of Liability
UnitedRaise is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the platform will be available at all times or free of errors. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to lost donations, campaign failures, or technical issues.
Our total liability for any claim arising from these terms or your use of the platform is limited to the amount of fees you have paid to UnitedRaise in the 12 months preceding the claim, or $100, whichever is greater.
15. Indemnification
You agree to indemnify and hold harmless UnitedRaise LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
16. Dispute Resolution
Any disputes arising from these terms or your use of UnitedRaise shall first be addressed through good-faith negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits against UnitedRaise LLC.
17. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Delaware.
18. Changes to Terms
We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms. We will notify you of significant changes by email or through a notice on the platform at least 30 days before they take effect.
19. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
